Many people believe that they do not need a will.   In fact, every person needs  a Will, a Durable Power of Attorney and a Living Will, or Advanced Health Care Directive, as they are known in Alabama.    

Often people die with  more complex legal issues than they could have been foreseen.   You never know what will happen between now and the time you die.   Wills determine much more than what will happen to your assets.   If you do not have a will, then many important decisions about your estate, your children and who will administer your property will be decided by the State.    Regardless of what you think, a well written will that stands up to scrutiny, is worth much more than it costs.    

A durable power of attorney will allow someone to administer your affairs if you are unable to.   A will or other testamentary device will not have any power until after your death.   With a Durable Power of Attorney, if you become incapacitated for any reason, a loved one will have the power to handle your business without first obtaining a court order.    

Everyone has heard the horror stories of someone being plugged up to life support for years while being in a coma.   Advanced Health Care Directives allow you to make important decisions now so that your loved ones will not have to when you are unable to make these decisions yourself.   Alabama's laws concerning living wills are very specific and only allow certain decisions to be made.   I make sure that my clients understand  the decisions that they are making that might have drastic consequences for the way they may be forced to leave this life.
